AMENDED AND RESTATED BY-LAWS OF BELLA VISTA TOWNHOME HOMEOWNERS ASSOCIATION, INC

NOTICE OF PROPOSED AMENDED AND RESTATED DECLARATION AND BY-LAWS.

OWNER DECISION FORM.

Your Board of Directors has determined that the existing Bella Vista Declaration and By-Laws needed to be revised. This change requires the written (signed) approval of a minimum of 60% (49) of the owners of the Association. The revised documents have been prepared with the direction and assistance of the law firm of Costello Sury & Rooney, P.C. located in Oakbrook Terrace, Illinois.

The decision to revise the documents is a result of the following events and activities that have transpired since they were originally approved by Hartz Construction in 2015:

(A) Remove references to approvals needed from Hartz since they no longer own any of the property within Bella Vista.

(B) Recognize changes in the Illinois General Not-For-Profit Corporation Act of1986 as amended from time to time.

(C) Consider changes needed due to the passage of the “Illinois Common Interest Community Corporation Act” CICCA.

(D) Incorporate any requirement mandated by the “Corporate Transparency Act” which was recently adopted.

(E) Make minor changes to ensure consistency between these documents and the policy and procedures instituted since we 

      assumed management responsibility for the Association’s activities in 2020.

To ensure that all owners receive these revised documents we request that as soon as you receive this email, you acknowledge, by responding to Lela LaHa immediately, either by email or a phone call, that you have received the email and the related documents. 

If Lela does not get a return email or phone call within seven (7) days you will be contacted via a telephone call to confirm whether or not you received the information.

If you want a hard copy of any of these documents, which are attached to this email, and cannot print them, please contact one of the Board members and we will deliver them to your home. These documents are also posted on our Bella Vista HOA website. We are aware that a few owners are not connected to the internet and we will deliver hard copies of this email and documents to them.

Please approve or disapprove, and then return the signed “Owner Decision Form” which is included as an attachment to Lela. All three HOA Board members will also have blank Owner Decision Forms available, if don’t want to print or cannot print a copy. We hope to get this completed before the end of January.

If you have any questions or comments, before (or after) signing the document, please contact any one of the Board members. 

When, and if, we receive written approval from 60% (49) of the owners to proceed, the signed documents will be submitted to the appropriate village and county officials, thereby replacing the existing documents.

HOA Board Meeting

The HOA Board is holding a “Directors Meeting” 12-16-2024 4:00pm at the clubhouse. Residents can listen, but not participate in the meeting. Also, some topic discussions are “Directors Only” therefore residents will need to leave the room when those topics are discussed.

Speed Limit Sign Moved

Recently, we had a request to move one of the speed limit signs from the west end of Bella Vista Blvd by Coral Gables to the middle of Bella Vista Blvd by Solara Court. The speed limit sign has been moved.

HOA Annual Meeting Reminder

The Bella Vista HOA Resident’s Annual Meeting is happening Wednesday October 30 at 7:00 at the clubhouse.

Please submit all questions to the HOA Board by 10/28/2024 at 12:01pm. Any questions received after that deadline, may not be answered during the meeting as the HOA Board members may need time to discuss and agree upon a proper response.

Fall Landscaping Activities

10/20/2024

In November, the Landscapers will be doing aeration, overseeding and “end of season” cleanup. The HOA Board has postponed all “sod activities” until springtime. More information on “sod activities” will come in the spring, whenever that gets here.

Bella Vista Annual HOA Meeting

Reminder: The Bella Vista HOA Annual Meeting is being held October 30 7:00pm at the Clubhouse. If you have any questions that you want answered, please email them to the HOA Board members. We will try to allow time for all questions. Note: Any questions not appropriate for a group meeting will be answered via email.

Mowing and Herbicide Update

09/25/2024

No mowing on 09/26, as the grass is still trying to recover from ~6 weeks of “no rain”.

Additional herbicide will be put down tomorrow, as weeds love rain. A product called Drive XLR8 is being used to combat crabgrass.

As always, try to keep your pets off the grass for a few hours after the application in your area, just to be safe.

In addition, an “organic Greener” is being tested in the large area (previously sodded North side) on Belle Vista.

HOA Board Election Candidate Deadline Passed

The HOA Board Candidate application deadline of September 16 12:01PM has passed. We only have two candidate applications for the two open HOA Board positions, thus there will not be a formal election this year. 

Please congratulate Lela and Don on their new 2 year terms as Bella Vista HOA Board Directors. When the new HOA Board meets for the first time, we will decide “2025 Director” assignments.

Spraying Herbicide for Crabgrass

09/03/2024

Please be advised that our landscaper will be spraying a herbicide throughout the property tomorrow. (09/04/2024) Please stay off the sprayed area until it is completely dry. Generally 2 or 3 hours after it is applied.

2024 HOA Election Applications

The Bella Vista 2024 Election Committee is now accepting applications for 2 HOA Board positions. 

Current HOA Board members Lela LaHa’s and Don Wittmer’s 2 year terms are expiring on October 31, 2024. They have both expressed the desire to run again for the 2 open positions. 

We are accepting candidate applications until SEPTEMBER 16 12:01 PM. Candidate applications received AFTER that deadline WILL NOT be accepted. 

If you want to run for a HOA Board position, please let us know and we will send you a candidate application form.

Ken Madeja and Charlie Breier have agreed to join the 2024 Election Committee. Bella Vista HOA Election Day is Wednesday October 30.

Street Light Update / Fixed

09/06/2024

Fixed for $330. This is why the HOA replaces the light bulb on our own first (for ~$30) to see it that is the problem.

We changed the light bulb, unfortunately it did not fix the problem. A electrician has been contacted. No timeline available.

Street Light Out

08/27/2024

The street light on Bella Vista and Bradford is out. We will be checking to see if it is simply the light bulb, which we can change, or if it is something more serious. We change the light bulb first, as if that is the problem, we save about $200 in electrician costs.

Concrete Work

07/23/2024

There will be multiple sidewalks replaced over the next few weeks, weather permitting. Costs will be detailed in our financials as always. These replacements are due to “bad concrete and finishing” by Hartz’s concrete contractor. Hartz is not accepting any responsibility for their actions.
